Liability waiver · Nido de Mar experiences

To confirm your booking, reply to our email with the following sentence:

“I have read and accept the terms and conditions of the Nido de Mar experiences”

Right of admission: Nido de Mar reserves the right to refuse admission or cancel the participation of anyone who does not send an email accepting these terms and conditions.

Terms and conditions

Nido de Mar experiences

  1. Assumption of risk

    I understand that water activities (boat tour, kayak, paddle surf and wakeboard) involve certain inherent risks, including but not limited to: changing water conditions, sun and weather exposure, physical exertion and possible capsizing. I voluntarily assume all risks associated with these activities.

  2. Physical health and weight limit

    I certify that I am in good physical health and have no medical condition that prevents me from participating safely. Where the activity requires it (kayak and paddle surf), I confirm that I meet the weight requirement (not exceeding 250 pounds / 113 kg).

  3. Equipment and personal belongings

    I understand that Nido de Mar is not responsible for the loss of or damage to personal items (phones, cameras, jewellery, etc.) that I carry during the activity. I am responsible for keeping my belongings in waterproof bags.

  4. Safety equipment

    I agree to wear a life jacket at all times while in the water. Failure to follow the staff's safety instructions may result in the immediate cancellation of the activity with no right to a refund.

  5. Right of admission

    Nido de Mar reserves the right to deny admission or cancel the participation of anyone who does not meet the safety requirements or the established limits, or who does not follow the guide's instructions. This includes anyone who appears to be under the influence of alcohol or substances that could compromise their safety in the water. No refunds will be given if service is denied on these grounds.

  6. Release of liability

    By taking part, I release Nido de Mar, its guides and employees from all liability, claim or cause of action for any injury or damage arising from my participation in the experience.

  7. Medical insurance with sports and adventure cover

    Nido de Mar strongly recommends that all participants hold travel and medical insurance with sports and adventure cover; any accident must be covered by each individual.

  8. Photographs

    I authorise Nido de Mar to use photographs taken during the activity on its social media. Nido de Mar will remove any photograph in which the customer has stated, by any means, that they do not authorise its use.

  9. Requirements for minors

    For a minor to take part in our activities, authorisation from their legal guardians is essential. This consent must be provided by means of a written, signed permission, mandatorily attaching a copy of the identity document of the authorising parent or guardian. Without this complete requirement, the minor will not be allowed entry or participation under any circumstances.

Guide and roadmap for your experience

So that you can enjoy the activity in complete safety and comfort, please keep the following recommendations in mind.

Requirements and safety

  • Weight limit: the maximum capacity is 250 pounds (113 kg) per person for kayak and paddle surf.
  • Secure your belongings: everything you bring must be well fastened; any loose object could be lost if it falls into the water.
  • Protect your devices: use a waterproof bag for your devices. Phones must be water-resistant or kept in a floating waterproof case.

Recommended clothing

  • Daytime activities: wear clothing that protects you from the sun, such as breathable shirts, leggings, a hat and sunglasses.
  • Be ready to get wet: wear clothes you don't mind getting wet.
  • After the activity: don't forget to bring a towel and dry clothes for the way back.

Essential items to bring

  • Sun protection: always carry sunscreen with you.
  • Night activities: a portable torch or head torch is mandatory for all night-time activities.
  • Hydration: bring plenty of water and your favourite drinks; we recommend a small portable cooler.
  • Full day: if you join us for the whole day, remember to bring breakfast for the road and extra money for lunch.

Technical skills and safety protocol

  • Certifications: we recommend completing a technical certification course before taking part in the activities that require it. Each excursion has specific technical and physical level requirements.
  • Skills assessment: tell the guide if you do not hold the necessary certification or if your level is below what the excursion requires. The person in charge will assess your skills and explain the technical requirements.
  • Swimming ability: if you cannot swim, you must inform the guide before the activity begins.
  • Authority on the water: all participants must follow the guide's instructions at all times, without exception.
  • Safety decisions: the guide has full authority to make any decision related to the group's safety, including restricting the participation of anyone who does not meet the necessary conditions.
  • Acknowledgement of risks: by confirming that you have read these guidelines, you accept that Nido de Mar and the guide are released from civil liability for any accident. Each participant acknowledges that they are responsible for their own safety and actions during the activity.

Water safety

Recommendations of the Maritime Authority

  1. The staff hold the relevant qualifications according to the nature of the activity (licence according to the vessel, first aid, lifeguard, etc.).
  2. Safety instructions are given to users, including the mandatory use of life jackets.
  3. Constant communication is maintained with the Maritime Authority.
  4. Safety equipment is supervised and actions to prevent accidents are identified.
  5. Operation by people under the influence of alcohol is prohibited.
  6. A maximum number of users per operation is set, without exceeding the capacities specified for the equipment.
  7. Minimum and maximum height, weight and age are established.
  8. Operations are suspended in the event of hazardous weather conditions, such as rain and electrical storms.
  9. The area's ecosystem is cared for.
  10. The person in charge has the phone numbers of the emergency services (Maritime Authority, National Police, Red Cross and others).

These terms are provided in several languages for convenience. In the event of any discrepancy between versions, the Spanish version shall prevail.
